Green Card Lottery 2027 Court Developments

Our earlier DV-2027 court-order article covered the October 14 injunction. On October 19, the district court issued its written reasoning. The State Department appealed to the Ninth Circuit that day and asked the district court to stay the injunction during the appeal.

The Ninth Circuit opened case number 26-6943 on October 20. The current schedule calls for the government’s opening brief on November 17 and the response of the plaintiff, the law firm Red Eagle Law, on December 15, 2026.

On October 21, Judge Jinsook Ohta denied the stay request. She also entered an amended injunction that replaced the earlier short orders. As a result, the State Department remains subject to the registration timetable unless another court changes it.

When Must Registration Open?

The amended order requires an official announcement by midnight EST on October 29. The announcement must identify the opening and closing dates, entry site, and eligibility terms. Registration must open by midnight EST on November 1 and remain available for 30 days.

These are outside deadlines, so an earlier announcement or opening remains possible. A later Ninth Circuit stay could affect the schedule. As of October 23, the appellate docket did not show a separate stay motion.

The court also ordered notice to selected entrants by December 3. The Department may seek an extension of that notice date by October 30. The amended order does not provide the same extension procedure for opening registration.

Why Did the Court Deny a Stay?

The court reasoned that a stay would effectively cancel the congressionally required DV-2027 program. It also found that selection notice is not an irreversible visa decision, because selected entrants must still submit visa applications and meet the eligibility requirements of federal immigration law.

The court did not treat staffing and resource burdens as irreparable injury. It noted that recent programs selected roughly 100,000 people for about 55,000 visas. The stay analysis applied the framework from Nken v. Holder, 556 U.S. 418 (2009).

What Should Potential Entrants Do Now?

DV-2027 instructions were not yet published, so the eligible-country list remains unconfirmed. Applicants should not assume that Türkiye is eligible until the instructions say so. Two rule changes already apply to green card lottery 2027 entries, however. Since September 16, 2025, State Department rules collect a $1 electronic registration fee at the time of entry. Since April 10, 2026, each entrant must also give valid, unexpired passport details and upload a scan of the passport’s biographic page, unless an exemption applies.

Potential entrants can check that their passport is valid and prepare accurate biographical information and a current photograph. Once registration opens, use only dvprogram.state.gov and pay the $1 fee only inside that official process. The State Department warns that no other organization or private company is authorized to notify entrants that they were selected.

Our DV timing article provides background, while the lottery scam guide explains common warning signs.

People exploring a non-lottery, self-petitioned immigrant option may separately review the EB-2 NIW service. NIW has its own legal and evidentiary requirements and is not an automatic substitute for DV eligibility.

Some lottery winners from Türkiye settle in cities with established Turkish communities. Our Clifton and Houston guides cover a driver’s license, a Social Security number, school enrollment and the Turkish consulate.

Common Mistakes

  • Treating the injunction as proof that registration is already open
  • Assuming an appeal automatically stays the order
  • Declaring country eligibility before instructions appear
  • Using a private site instead of the official portal
  • Waiting until registration opens to check passport validity
  • Letting a third party keep the confirmation number

Checklist

  • Verify announcements on travel.state.gov.
  • Enter only through dvprogram.state.gov.
  • Read the DV-2027 instructions in full.
  • Prepare a valid passport, a scan of its biographic page, the photograph and personal data carefully.
  • Retain the confirmation number securely.

Frequently Asked Questions

Is November 1 the guaranteed opening date?

It is the latest opening time under the current order. The Department may open earlier. A later appellate order could alter the schedule.

Did the government’s appeal stop the injunction?

No. An appeal alone does not stay an injunction, and the district court denied the government’s stay request.

Is green card lottery 2027 registration free?

No. The State Department fee schedule sets a $1 electronic registration fee, collected at the time of entry. The DV-2027 instructions will show how it is collected. Pay it only within the official registration step on dvprogram.state.gov.

Is Türkiye eligible for DV-2027?

The DV-2027 instructions and country list were not published as of October 23. Eligibility should not be stated until the official instructions appear.

Conclusion

The current green card lottery 2027 order creates firm outside dates for announcement and registration, but the entry site is not open yet and the appeal continues. Prepare your entry from the official instructions once they are published. Applicants should monitor official sources, have a valid passport ready, and avoid private sites that charge service fees or promise selection.
